Robert Babayi - President

Robert Babayi's practice focuses on client counseling, patent prosecution, licensing and litigation. Mr. Babayi was in-house counsel at Motorola Inc. and IBM Corp. and understands patents at a very practical level and is familiar with licensing and portfolio strategy especially in the electrical, software and mechanical fields.

Mr. Babayi has prosecuted several hundred US patents with primary emphasis on wired and wireless telecommunications, computing architecture, network layer protocols, semi-conductors, manufacturing processes, power systems, object oriented programming and the Internet and e-commerce related inventions.

Mr. Babayi is very familiar with PCT practice, reexamination and re-issue proceedings. Mr. Babayi is also familiar with global patenting strategies.

Mr. Babayi counsels clients on validity, enforceability, and infringement of patents. He provides strategic advice on relevance, strength and value of patents to commercial markets. Mr. Babayi analyzes the risks associated with enforcing or defending patent portfolios, negotiates licensing terms, and manages patent licensing programs.

Mr. Babayi has been involved in defensive and offensive aspects of complex patent litigations before the ITC and in the District Court level. He has taken and defended depositions, selected experts and prepared fact and expert witnesses for testimony. Representative cases include:

Agere Systems Guardian Corp. v. Proxim, Inc., No. 01 339 RRM (D.Del. 2001), represented plaintiff in infringement action concerning patents related to wireless technology under IEEE 802.11 standard.

In re Certain Wireless Local Area Network Cards, ITC Investigation 337-TA-455, represented one of the intervenors in an action involving wireless local area network (LAN).

Mr. Babayi is the author of an article entitled “The Objective Standard For Claim Construction: Patentee Beware,” published in the Summer 1999 Issue of Counsellor, a newsletter of Burns, Doane, Swecker and Mathis LLP.

Mr. Babayi is a co-inventor named in two U.S. Patents relating to Code Division Multiple Access (CDMA) technology.

Salman H. Elmi - Chapter Representative to National Board

Salman H. Elmi was born in Bridgeport, Connecticut. He attended the University of Michigan at Ann Arbor, where he completed the pre-medical course requirements, graduating with two Bachelor of Arts degrees in 1997. Mr. Elmi attended law school at Emory University School of Law, receiving his J.D. degree in May, 2000. While at Emory, he was awarded a letter of commendation for excellence in the Law School’s prestigious Kessler-Eidson Trial Techniques Program. Mr. Elmi was admitted to the bar of the State of Maryland in 2000, the District of Columbia in 2001, and the Commonwealth of Virginia in 2011. Mr. Elmi spent the first few years of his legal career focusing on FDA/Healthcare Regulatory matters at law firms in Washington, D.C. and New York City, before transitioning to pharmaceutical products liability litigation. Mr. Elmi is currently Senior Corporate Counsel at ACell, Inc., a bio-medical device manufacturer in the DC metropolitan region. Mr. Elmi is a member of the American Bar Association, and the District of Columbia Bar Association.

 


Anthony A. Fatemi

Mr. Fatemi is a seasoned attorney with vast experience in handling various types of immigration and litigation matters.
